Types of Bail Bonds

There are seven different types of bail bonds but not all states allow bail bonds or all seven types. Below are the three commercial bail bonds available in most states.

Surety bonds

This is the most common type, where a bail bondsman guarantees the full bail amount to the court on behalf of the defendant. The defendant pays a percentage (usually 10-15%) of the bail amount to the bondsman. 

Immigration Bonds

Immigration bail bonds only exist for offenses committed by individuals not from the United States (immigrants) and detained by immigration. Immigration bonds have VERY strict requirements and therefore a professional is recommended.

These are bail bonds for federal offenses.  Not all bail bondsman provide these and therefore a federal bail bond can be expensive or hard to obtain.  It is recommended a federal bail bonds specialist works with you.

What are the other types of bail bonds?

For other bond types, you may not require a licensed bail bondsman.  However, please note, not all states or courts will allow some bond types. Each type of bond will have a different set of requirements as well.

Property Bonds

The defendant can use property, such as real estate, as collateral to secure their release. If the defendant fails to appear in court, the property may be forfeited. 

Citation Release Bonds

For minor offenses, a law enforcement officer may issue a citation (like a traffic ticket) instead of taking the person to jail. 

Personal Recognizance (PR) Bonds

Also known as “own recognizance,” this type of bond allows a defendant to be released without paying any money. They simply sign a promise to appear in court. 

Cash Bail or Cash Bond

The defendant or someone on their behalf pays the full bail amount in cash to the court. If the defendant appears in court as required, the money is returned.
