States That Do Not Allow Commercial Bail Bonds:

These states have banned or significantly restricted private bail bond agents. Pretrial release is handled by the court system directly, often through cash bail, own recognizance (OR) release, or supervised pretrial services.

  1. Illinois – Commercial bail bonds were eliminated as part of criminal justice reforms. The Pretrial Fairness Act (2021) ended cash bail in 2023.

  2. Kentucky – Does not allow private bail bond agents. Bail must be posted directly with the court or through other means.

  3. Oregon – Commercial bail bonding is prohibited. Defendants post 10% of bail directly with the court.

  4. Wisconsin – Commercial bail bonding is banned. Bail must be paid directly to the court.

  5. Massachusetts – Although technically legal, commercial bail bonding is nearly nonexistent and tightly regulated.

  6. Nebraska – Similar to Massachusetts; allowed, but rarely used and subject to limitations.

  7. Washington D.C. – Not a state, but important to note: does not allow commercial bail bonds and uses pretrial services instead.
